Terms and Conditions of doing business with X8 IT LLC and all subsidiaries including X8 Marketing℠, X8 Gaming℠ and X8 Web Design℠ henceforth referred to as “X8”
Due to the investment of X8 resources and personnel, all graphic design and custom marketing materials require payment in full upon project commencement.
Website deposit is 50% of website development invoice items indicated by partial payment allowed through PayPal, Stripe, Square, QuickBooks, Freshbooks, or any other invoice or merchant processing system.
Custom graphic design and website deposits or incremental payments, are non-refundable once work has commenced. Websites do not “Go Live” until paid in full. No exceptions. All project materials and intellectual properties in part or in whole, are the explicit property of X8 until the project has been paid for in full and are subject to confiscation accordingly.
All X8 projects are custom and therefore delivery timeframes are custom based on the individual project and its needs. Projects shall begin upon receipt of all necessary items from client (first half invoice payment, site start survey, and other credentials as discussed with X8 rep including but not limited to logo files, hosting and domain login credentials, etc.) Remaining website content including copy shall be provided by client within 14 days of prototype review or additional charges may apply.
Scope expansion: Details of site project are specifically listed in the invoice. Additional pages, functionalities, integrations, or plugins are considered expansion of scope. These must be approved by both X8 and client in writing/email. Additional hours are billed at $150/hour.
By submitting payment in full or in part, for services to be rendered, you are explicitly and irreversibly agreeing to these terms and conditions. Should you initiate a dispute with PayPal, Stripe, Square, your card provider, or any other payment processing services, in regard to any portion of this payment, you agree to forfeit your deposit and any payments made.
Website pricing is based upon X8 badging remaining in the website footer. Should this be removed, client is responsible for all licensing of software, images and plugins.
All X8 resources, including but not limited to software, templates, code, source code, code snippets, plugins, combinations of plugins, plugin variations, licenses, designs, images, likenesses, variations of any of the aforementioned items and/or processes are the explicit intellectual property of X8 Web Design/X8 IT LLC. Replication or other misuse of X8 resources or X8 systems is prohibited. X8 websites MAY NOT be replicated for use on sites or domains other than the single original site they were paid to be used upon. The X8 design system and automations built within are proprietary and may not be replicated, duplicated or resold without explicit permission from an X8 Executive.
X8 or its stakeholders, benefactors, contractors, employees or executives, are not liable for any business damages caused by website or business downtime due to site or material production or execution. This is an assumed risk of doing business when changing, updating or integrating technological projects.
Gaming and Sweeps Clients Only: Automated (cashier-less) gaming and sweeps systems are billed/auto-paid on a daily or weekly basis. Use of these systems is considered a license of said software and that license may be revoked at the discretion of X8 executives when an account becomes 14 days past due. All automated gaming systems are required to remain on automatic payment systems or the license may be revoked immediately. X8 is not liable for lost revenue or damages for the revocation of gaming system licenses and may choose to do so, at any time.
All projects, transactions and business currently in process, or thereafter the date posted of this notice, are subject to these terms. These terms apply in full, unless specifically approved in writing or by verified email by an X8 Executive, specifically Jay Choquette or Stephanie Choquette.
Any litigation or arbitration is to occur in Gillespie County, TX, the primary operating domain of X8 companies.

Frequently Asked Questions
Once my website is launched, what is my relationship with X8 going forward?
We are here to empower you and your business to control your own site and business destiny. Once we have built your site and it is paid for, you own it in its entirety! The only restriction is that you cannot replicate/duplicate them for a secondary site use or resale. We will also do touchups for up to 30 days on your site (assuming they are not an expansion of project scope). After that, it is important that you update your site regularly and maintain it to ensure security and that you are presenting your business in a credible and professional manner to maximize your opportunities. Instructions for updating your site will be provided upon launch.
If you would like us to do your maintenance for you, please register as a client on our site and select a subscription of your choice (they start at 150/month). You can do that here: https://x8webdesign.com/subscriptions/ and you will then be billed monthly while we handle the rest for you.
Updates to sites post-project can also be completed at an hourly rate of $150/hour.
